THINGS TO KNOW

Days before their ability to use Design Build expires, BCHD plans to contract a builder and adopt a resolution that immediately turns the contract over to its private developer. From the staff report: “The District will execute the A141 Design Build Contract & Immediately Assign to PMB, who will be the Owner.”

This last-minute action comes as the Design/Build statute for BCHD is set to expire on 12/31/22. Design Build allows the BCHD to select a builder without going out to bid. Simply put, 5 years after Al Muratsuchi passed the statute, BCHD is trying to apply it, without a final project approved. BCHD has not yet applied for its required final Conditional Use Permit and Design Review, the final project has NOT BEEN approved by the City of Redondo Beach, the contract is INCOMPLETE.

  • The contract is largely incomplete. 10 OF 14 exhibits which make up the contract are placeholders with "to be added by amendment" with no exhibits for key detailed items such as pre-construction cost, design, and schedule. 

  • BCHD has little to no control. "Time is of the essence" clause for build timelines and built-in late schedule penalties leave the public little confidence. Who will monitor the builder?

  • Non-transparent. The Board has basically abdicated its role and given  authority to the CEO and CFO to "execute, deliver and consummate the design build agreement, which further obscures important project actions from the public purview.

  • "RESOLUTION NO. 586 includes:"Redevelopment of the campus as contemplated by the proposed Project will require significant resources, financial and otherwise, including incurring substantial risk."

“Resolution #586 includes the recital that immediately following the execution of the A141 Design-Build Agreement (DBA), the District will have been authorized to assign all its rights and obligations under the DBA to PMB/Watermark, and PMB/Watermark and Suffolk/CallisonRTKL would release the Beach Cities Health District from its obligations….While there are some upcoming large milestones ahead, like finalizing the Ground Lease 120 Day Due diligence period and the filing of a Conditional Use Permit application (CUP) with the City of Redondo Beach, completing the Definite Agreements will allow for the development to continue towards creating a Healthy Living Campus for the community.”
